EastmanPublishing.com provides users a fun and easy way to process, print, and share photographic images that are combined with calendars to share with family and friends.

This agreement describes the terms and conditions applicable to your use of EastmanPublishing.com Photo Calendar services.

We may amend this agreement at any time. Terms may be changed or updated at any time without notice, but you can always find the most recent version here.

It is important that you carefully review the Terms and Conditions set out below before you use the EastmanPublishing.com Photo Calendar services.

We suggest that you periodically check this page to make sure you are up to date.

By entering and using the Photo Calendar site, you indicate that you accept the Terms and that you agree to be bound by and subject to them. Acceptance of the Terms creates a binding legal agreement between you and EastmanPublishing.com that you will use the Photo Calendar section only in a manner that is consistent with the Terms.

Eastman Publishing does not claim any ownership rights in any photos that you choose to upload for a Photo Calendar. After posting a photo and its description, you continue to retain all ownership or license rights in your photos and you continue to have the right to use your photos as you did prior to such posting.

However, by posting or making photos available through the Photo Calendar section, you hereby grant to Eastman Publishing a nonexclusive, royalty-free, worldwide license to use, copy, modify, publicly display within the Photo Calendar section and process your photos, for suitable display within the Photo Calendar section. In addition, where you have made your photos public, without limitation to the printing services offered by EastmanPublishing.com.

In connection with the above license, you provide your consent for the purpose of providing Photo Calendars and filtering content that violates this Agreement. You acknowledge that you are solely responsible for all photos you submit to or provide to the Photo Calendar section. You represent that you either own the photos or have the rights necessary to grant Eastman Publishing this license.

Your license to Eastman Publishing with respect to any particular photo submitted will terminate once you or EastmanPublishing.com remove it.

EastmanPublishing.com prohibits the posting of photos or descriptions that constitutes nudity, sexually explicit or graphic material, invasive of another's privacy and/or, in the opinion of EastmanPublishing.com, is objectionable or in poor taste. Swimsuit and/or lingerie photographs are to be in good taste, and aren't to be in an obscene nature or intent that violates local, provincial or national laws.

EastmanPublishing.com is the final arbiter of what is allowed and not allowed in the Photo Calendar section. If a portion of material posted is found to be in violation of the Terms and Conditions of Use set forth in this section, the entire Administration Area access and all photo posting associated with it may be removed.

Users of the Photo Calendar section must be at least 13 years of age. Children under the age of 13 are not permitted to use the Administration Area and no information of children under the age of 13 will be knowingly collected by Eastman Publishing. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without the parent or guardian's consent by, for example, misrepresenting his or her age, that parent or guardian should contact us.

You agree to the terms, conditions, notices and guidelines contained in these Terms of Use and, where applicable, you represent that you have obtained permission from either your parent or legal guardian to perform any of these functions if you are under the age of 18.

Parents or legal guardians of users under the age of 18 understand and accept that some calendar photos on the Photo Calendar section may contain swimsuit and/or lingerie photographs that, in some cases, may be considered inappropriate for viewing by children. As with any other electronic or printed material, parents should determine which materials they consider appropriate for viewing by their children.

If you believe that any of the content posted by EastmanPublishing.com Photo Calendar users violates the Terms of Use set forth here, please report it to EastmanPublishing.com.

Photos stored on EastmanPublishing.com are for online Photo Calendar sharing purposes and not meant for permanent or temporary archival purposes. Therefore, EastmanPublishing.com is not obligated to maintain back-up copies of any material submitted or posted on EastmanPublishing.com.

EastmanPublishing.com reserves the right to remove the Photo Calendar section in whole or in part from the EastmanPublishing.com web site at any time without notice.

All calendar photos are the sole responsibility of the person from which the photo originated. EastmanPublishing.com does not control photos that are maliciously acquired from a third party.

Subject to your compliance with the terms and conditions of this Agreement, EastmanPublishing.com grants you a non-transferable, non-sublicensable right to access, view and print public Photo Calendars, only for your personal, non-commercial use. With the exception of your own photos, use of any Photo Calendars commercially, or otherwise copy, modify, distribute photos that didn't originate from you is prohibited.

You do not have the right to post and/or upload any photos that you do not have the lawful right to copy, transmit and display. Do not use any photos for which you do not have the consent or permission of each identifiable person in the photo to use the name, photograph, or likeness of each such person; or any photos that infringes the intellectual property rights or violates the privacy rights of any third party (including without limitation copyright, trademark, patent, trade secret, or other intellectual property right, or moral right or right of publicity).

Do not post and/or upload any photo that is unlawful, obscene, harmful, threatening, harassing, defamatory, or hateful, or that contains objects or symbols of hate, invades the privacy of any third party, contains nudity or pornography (including without limitation any child pornography or child erotica), is deceptive, threatening, abusive, inciting to unlawful action, defamatory, libelous, vulgar or violent, or constitutes hate speech, or is otherwise objectionable in the opinion of EastmanPublishing.com.
